General Terms and Conditions for the use of the services of campaigncall.com
1. Scope and Subject Matter of the Contract
These Terms of Use govern the legal framework for the use of the services of campaigncall.com (hereinafter "Provider"). The Provider offers consulting and planning services in the field of communication strategies for public campaigns. This includes the analysis, conception, and support of communication processes for the effective dissemination of information to the public.
The specific services are individually agreed upon in a separate contract or service description between the customer and the Provider. These conditions apply to all business relationships between the Provider and its customers.
2. Rights and Obligations of the Contracting Parties
2.1 Obligations of the Provider
The Provider undertakes to provide the agreed services with due care and expertise. The consultation is based on recognized methods of strategic communication.
- Creation of a communication strategy tailored to the target audience.
- Consultation on the effective design of information campaigns.
- Support in the planning and implementation of communication measures.
2.2 Obligations of the Customer
The customer is obliged to provide all information, documents, and data necessary for the fulfillment of the contract truthfully, completely, and in a timely manner. The customer bears the content responsibility for the information provided by them and the final decision regarding the implemented measures.
3. Limitations of Liability
The Provider is fully liable for intent and gross negligence as well as for injury to life, body, or health. For slight negligence, the Provider is only liable in the event of a breach of a material contractual obligation (cardinal obligation); this liability is limited to the foreseeable, typically arising damage.
Liability for the success of a campaign or communication strategy is expressly excluded. The Provider provides consulting services; the actual success depends on numerous factors not controlled by the Provider (e.g., market development, public response, actions of third parties). Statements such as "guaranteed success," "immediate effect," or "result guaranteed" are not made.
4. Remuneration and Payment Terms
The remuneration is based on the agreed service description. Invoices are due within 14 days of the invoice date without deduction. In the event of default, the Provider charges default interest at the statutory rate.
Prices are quoted plus statutory value-added tax. The Provider reserves the right to adjust its prices for long-term contractual relationships while observing a reasonable notice period.
5. Contract Duration and Termination
The contract duration results from the individual agreement. For contracts of indefinite duration, a notice period of one month to the end of the month applies. The right to terminate without notice for good cause remains unaffected for both parties.
Good cause exists in particular if the other contracting party violates essential contractual obligations despite a warning or is involved in insolvency proceedings.
6. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes, insofar as legally permissible, is the registered office of the Provider.
The Provider reserves the right to change these Terms of Use. Changes will be communicated to customers by email and are deemed approved if the customer does not object within four weeks of receiving the notification. This legal consequence is pointed out in the change notification.
